Welcome to Lava Co. These Terms of Service ("Terms") govern your access to and use of the website, web application, and services provided by Lava & Co Management ("Lava Co," "we," "us," or "our"). By using our platform or services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, creating an account, booking a cleaning service, or using any feature of our platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. Description of Services

Lava Co provides an online platform for booking and managing premium cleaning services in the Los Angeles area and surrounding regions. Our services include but are not limited to:

  • Residential Cleaning: General cleaning, deep cleaning, event cleaning, and touch-up cleaning for private residences.
  • Short-Term Rental / Airbnb Turnovers: Guest turnover cleaning, maid service, linen changes, and property resets.
  • Commercial Cleaning: Office, medical/clinic, and retail space cleaning (standard and deep).
  • Move-In / Move-Out Cleaning: Full property cleaning for transitions, including our LAVA Special exit cleaning.
  • Post-Construction Cleanup: Initial debris removal, final detail cleaning, and touch-up cleaning after renovations or new builds.
  • Add-On Services: Interior windows, oven/refrigerator cleaning, laundry, cabinet interiors, balcony/patio, BBQ/outdoor kitchen, and more.
  • Premium Options: VIP arrival windows, hotel-style turndown, eco-friendly supplies, and signature scent packages.

3. Account Registration & User Roles

3.1 Account Creation

You may create an account on our platform as a Client, Cleaner (independent contractor), or Property Manager. Accounts may also be auto-created when you submit a booking request through our public quote form. You are responsible for:

  • Providing accurate, current, and complete information during registration.
  • Maintaining the security and confidentiality of your password.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized access or use of your account.

3.2 User Roles & Permissions

  • Client: Book cleaning services, view quotes, make payments, manage property details, and rebook from saved information.
  • Cleaner (1099 Contractor): View assigned jobs, start/finish jobs with timestamps, upload before/after photos, track earnings, and export reports.
  • Property Manager: Manage multiple properties, request cleanings, and oversee service history.
  • Admin/Owner: Full platform management including user management, job assignment, pricing, and analytics.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct that harms Lava Co, its users, or third parties. You may request account deletion by contacting us at info@lavacomanagement.com.

4. Booking & Pricing

4.1 Quotes & Pricing

Prices displayed during the booking process are estimates based on the information you provide (property size, type, cleaning category, add-ons, surfaces, and frequency). Final pricing may be adjusted if actual conditions differ materially from the information provided (e.g., significantly more square footage, undisclosed conditions requiring extra work).

4.2 Transparent Pricing

We are committed to transparent, upfront pricing. All fees, taxes, travel charges, and discounts are shown before payment. There are no hidden fees, membership traps, or misleading introductory pricing.

4.3 Frequency Discounts

Recurring service discounts (weekly, bi-weekly, monthly) apply to ongoing scheduled bookings. If you cancel recurring service, future bookings revert to one-time pricing.

4.4 Luxury Surface Care

Properties with specialty surfaces (marble, onyx, hardwood, delicate finishes) may incur a care surcharge to cover premium products and specialized handling.

5. Payments

5.1 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable amount for booked services. We accept major credit and debit cards.

5.2 Payment Timing

Payment is collected at the time of booking via Stripe Checkout. For recurring services, payment is automatically charged before each scheduled service.

5.3 Refunds & Cancellations

  • Cancellation more than 24 hours before service: Full refund.
  • Cancellation within 24 hours of service: 50% cancellation fee may apply.
  • No-show or same-day cancellation: Full charge may apply.
  • Service quality issues: If you are unsatisfied with the service, contact us within 24 hours. We will arrange a re-clean at no additional cost or issue a partial/full refund at our discretion.

5.4 Failed Payments

If a payment fails, we will attempt to notify you and retry the charge. Continued failure to provide valid payment may result in service suspension.

6. Service Delivery

6.1 Access & Entry

You are responsible for providing accurate access information (gate codes, lockbox codes, alarm codes, parking instructions, pet details). Lava Co is not liable for delays or inability to perform services due to incorrect or missing access information.

6.2 Property Condition

You represent that the property is in a safe and accessible condition for cleaning. Lava Co reserves the right to decline or discontinue service if conditions present a health or safety risk to our team (e.g., biohazards, structural hazards, infestations).

6.3 Pets

If you have pets, you must disclose this during booking. Aggressive pets must be secured during service. Lava Co is not liable for pets that escape or are injured due to inadequate containment.

6.4 Photos & Quality Assurance

Our cleaners take before and after photos of each room as part of our quality assurance process. These photos are used for service verification, training, and dispute resolution. By using our services, you consent to photography of your property's interior during cleaning.

6.5 Damage & Liability

Lava Co carries general liability insurance. If our team causes damage to your property during service:

  • Report the damage within 48 hours of service completion with photographic evidence.
  • We will investigate and, if substantiated, repair or compensate at fair market value up to our policy limits.
  • We are not liable for pre-existing damage, normal wear and tear, or damage caused by concealed hazards.

7. Independent Contractors (Cleaners)

7.1 Contractor Relationship

Cleaners operating through Lava Co are independent contractors (1099), not employees. Cleaners are responsible for their own taxes, insurance, and compliance with applicable laws.

7.2 Cleaner Obligations

Cleaners agree to:

  • Complete assigned jobs professionally and according to Lava Co's luxury standards.
  • Upload required before/after photos for each room.
  • Maintain confidentiality of client access codes and personal information.
  • Not solicit Lava Co clients directly for services outside the platform.

7.3 Payouts

Cleaner payouts are calculated as a percentage of the job total, as agreed upon assignment. Earnings are tracked in the cleaner portal and can be exported for tax purposes.

8. Communications

8.1 Electronic Communications

By creating an account or submitting a booking, you consent to receive electronic communications from us including emails, SMS/text messages, and push notifications related to your account and services.

8.2 SMS/Text Messages

Our SMS practices are governed by our Privacy Policy, Section 3 (SMS/Text Messaging Policy). You may opt out at any time by replying STOP.

8.3 Chat Widget

Our website includes a live chat feature powered by GoHighLevel. Messages sent through the chat widget are recorded and may be used for customer support, training, and service improvement.

9. Intellectual Property

All content on our website and platform — including logos, text, graphics, software, and design — is the property of Lava & Co Management or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

10. Prohibited Conduct

You agree not to:

  • Use our platform for any unlawful purpose.
  • Provide false or misleading information.
  • Attempt to gain unauthorized access to any part of our system.
  • Harass, threaten, or abuse our team members, cleaners, or other users.
  • Circumvent our platform to book cleaners directly.
  • Use automated tools to scrape, collect, or access our platform data.
  • Upload malicious content, viruses, or harmful code.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAVA & CO MANAGEMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Lava & Co Management, its officers, directors, employees, contractors, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

13. Dispute Resolution

Any disputes arising from these Terms or our services will be resolved through:

  • Informal Resolution: Contact us first at info@lavacomanagement.com. We will attempt to resolve the dispute within 30 days.
  • Arbitration: If informal resolution fails, disputes will be settled through binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association.
  • Governing Law: These Terms are governed by the laws of the State of California.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our platform. Continued use after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lava & Co Management regarding your use of our services.
